We are GAMER UNLOCKED, UNIPESSOAL LDA ("Company," "we," "us," "our"), a company registered in Portugal at Rua Lourenço Pires, Lote 26, n.° 25, Chaves, Vila Real 5400-358. Our VAT Number is PT517826410.

We operate the website http://www.gamerunlocked.pt (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

Gamer Unlocked is a company that sells computer equipment, specializing in gaming gear.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and GAMER UNLOCKED, UNIPESSOAL LDA, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.

You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. 

Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

ORDERS

Gamer Unlocked offers different ways of placing orders:

  • Through our website - www.gamerunlocked.pt;
  • In writing, via email to orders@gamerunlocked.pt;

Gamer Unlocked reserves the right to limit the purchase quantity of any product/reference for each customer within the framework of major promotional periods.

PRICES

The prices of the products presented for sale by Gamer Unlocked are those displayed on the website www.gamerunlocked.pt, are invoiced in euros and include VAT at the legal rate in force on the date the order is placed.

Prices are valid unless there is a typographical error or an error on the site. Gamer Unlocked may change the price or cancel the order without prior notice.

Prices displayed on advertising platforms such as Instagram, TikTok and other social networks or advertising flyers are for information purposes only and the valid prices are displayed on the website www.gamerunlocked.pt.

All quotes provided by Gamer Unlocked are valid at the price level for a maximum of 7 days.

PAYMENT TERMS

Except for special conditions which must be agreed in writing, Gamer Unlocked's payment terms are as follows:

  • Multibanco references;
  • MBWay payment service;
  • VISA/Mastercard;
  • Paypal;

After payment has been completed, Gamer Unlocked will carry out a standard verification so that the order can be processed and shipped. The customer will receive an e-mail confirming that the order has been paid for, as well as the corresponding invoice.

DELIVERY

Confirmed orders for items in stock placed before 3pm are usually dispatched the same day (during the week). Larger orders usually have a longer delivery time if you don't opt for express delivery. Deviations may occur in the event of an increase in workload, as may be the case, for example, during Christmas, Black Friday, etc. delivery is not guaranteed. If we are unable to deliver an item within the promised timeframe, the customer has the right to cancel the purchase and return their order to us in accordance with the terms of the Open Purchase period(14 days). With regard to purchases of out-of-stock or pre-ordered items, it is not possible to inform you of the maximum delivery time, as this is beyond our control. We will send the order as soon as the products are back in stock.

This delivery time may be different if the product requires some technical intervention, as for example a computer with assembly. In this case, the assembly time will be added to the delivery time and will vary depending on the workload on the assembly line. In the event of stock-outs, the customer will be contacted in order to be informed of delivery times or to be offered alternatives to the equipment ordered.

SHIPPING

The invoice is the document proving the quantity of products sent. The customer must therefore ensure that the package is in good condition upon receipt of the product(s). Otherwise, if the package is damaged, shows signs of mistreatment or has been tampered with, you must make a written claim on the waybill on receipt and report the matter to Gamer Unlocked for the relevant purposes, by emailing support@gamerunlocked.pt with the Order ID.

For all orders placed online, the customer bears the shipping costs. Unless there's a campaign that offers discounted shipping fees.

CLAIMS

If the product(s) received do not conform to the Invoice, the Customer must alert Gamer Unlocked at that time or within a maximum of 14 (Fourteen) days from receipt of the product and sent by carrier to the customer, accompanied by a copy of the Invoice, which must be sent together with the respective claim.

Any claim relating to the product(s) must be accompanied by a copy of the order invoice. Illegibility or ambiguity that does not allow the Customer to properly use the product(s), good(s) or service(s) and that the product(s) are in their original state (in perfect condition and complete, i.e. packaging, manuals, cables, accessories, etc.), defective and, if it is necessary to prove this defect, you must send the product with its original packaging with the references useful for identification.

After 15 (Fifteen) days from delivery of the product(s), any claim will be subject to prior assessment by Gamer Unlocked, which may or may not be accepted, depending on the assessment of the Technical Department.

No claim will be accepted if the above conditions are not scrupulously respected.

RETURNS

Products sold can only be returned with the prior written agreement of Gamer Unlocked.

All products ordered through the website or via email that are not listed on the site (i.e., specifically ordered items) are not eligible for return.

Returned products to Gamer Unlocked must be in perfect condition and carefully packaged in their original boxes/packaging, without any modification to their references and serial numbers.

The labels must be intact, allowing for potential resale.

Customers can cancel their online orders at any time by contacting support@gamerunlocked.pt.

In the case of online purchases paid by credit card (VISA/Mastercard), customers can cancel the order if it has not yet been delivered, with the total amount refunded to their bank account quickly, simply, and conveniently.

For online purchases with the respective shipping service, customers have 14 days to exercise the right of withdrawal (return the product) without providing any justification, provided the product is returned intact, with undamaged packaging, or any other type of damage.

To exercise the right of withdrawal, the customer can contact the Customer Support Department by registered letter or email (support@gamerunlocked.pt).

After Gamer Unlocked has confirmed the return to the customer, the product(s) must be sent to: Rua Lourenço Pires, nº 25, Chaves, 5400-358. After Gamer Unlocked has confirmed the condition of the product(s), a credit note will be issued for the total value of the product, excluding shipping and return costs, which will be borne by the customer.

If the customer opts for a refund, it will be made by the same payment method or, if impossible, by bank transfer.

In exception, there are items which by their nature (for reasons of hygiene, safety, risk of data transmission, manufacturer's recommendations, etc.) cannot be accepted for returns/exchanges.

Without prejudice to the Customer's other rights, provided for herein or in the applicable legal regulations, exchanges or returns are not accepted for:

  1.  In-ear monitors (IEMs)/headphones/headsets, batteries, memory cards, external disks, consumables or software;
  2. Already assembled chairs, televisions, monitors, laptops, smartphones, tablets that have broken brand packaging seals.

In the case of Software, this implies, for example, that computers purchased with an operating system will not be eligible for the return of the operating system.

Gamer Unlocked reserves the right to refuse returns/exchanges of items whose Serial Number has already been registered/associated with a user account on the online platforms/apps of various manufacturers. The association of an item (via Serial Number) with an online platform/app may in many cases allow users no longer in possession of the items to control and track these items, while they are being used by third parties.

If any of these points are breached, we will not be able to accept the return/exchange (and the consequent refund or issue of a credit note).

WARRANTY

All items purchased at Gamer Unlocked through online means are covered by the legal warranty regime. Before purchasing a product, please consider the following points outlined on this page:

To activate the warranty, the item must be sent to the address of Gamer Unlocked at Rua Lourenço Pires No. 25, Chaves, 5400-358. After the warranty process is completed, Gamer Unlocked will send the customer the new/repaired item. If no malfunction is found, a transportation fee will be charged to the customer.

All products sold by Gamer Unlocked are not manufactured by the company. At the time of sale, Gamer Unlocked issues the respective invoice to the customer, a document that must be properly preserved to ensure the warranty of the purchased item.

Each manufacturer's warranty conditions are applicable, with a standard one-year policy. If the manufacturer offers a longer warranty, it is also valid during that period. In such cases, customers are advised to contact the manufacturer first. All specified warranties are valid in Portugal.

Products purchased less than 15 (fifteen) days ago with defects or malfunctions will be designated as DOAs (Dead on Arrival). DOAs are checked for malfunction as soon as they arrive at Gamer Unlocked's facilities. After confirming the malfunction, Gamer Unlocked will replace the item if repair is not possible within 5 (five) days, unless there is a stockout. In case of stockout, Gamer Unlocked will inform the customer about the delivery time for an identical product or the exchange for a similar one.

In cases of technical team review, Gamer Unlocked commits to examining the product as quickly as possible. However, customers must be aware that the process does not depend solely on the seller (Gamer Unlocked). All products received at our facilities for review are tested and dispatched as quickly as possible. From that point on, the process becomes the responsibility of manufacturers and suppliers.

For discontinued products, the exchange can be made for an equivalent or superior product currently on the market. However, this exchange is solely the responsibility of the supplier/manufacturer. Alternatively, a credit note may be issued so that the customer can later purchase other items in our store(s). This credit note always has a validity of 6 months.

The legal solution for the customer must be presented within 30 (thirty) days.

Please note that any alteration to the original product INVALIDATES THE WARRANTY. For example: removal of serial number stickers or other warranty-related labels, replacement of switches in mice, etc. In all these cases, the warranty claim is immediately REJECTED.

Whether the equipment has a warranty or not, whenever it is received for repair and no malfunction is detected, or if it has been caused by incorrect use, a fee may be charged to cover logistical costs.

Under no circumstances can Gamer Unlocked be held responsible for the partial or total loss of data, programs, or software installed on products delivered for repair.
